1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer" or "User") and SA Global Flooring ("Company", "we", "us", "our"), a business registered in the Republic of South Africa. By accessing and using our website, applications, and services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.
2. Definitions
- Services: Our flooring products, quotes, invoices, and related support
- Website: Our online portal at www.sa-global.co.za
- Products: Laminate, vinyl, rubber mats, and accessories offered
- Order: Your purchase request for Products
- Quotation: Our estimated pricing for Products
3. Use License and Restrictions
We grant you a limited, non-exclusive, revocable license to access and use our Website for personal, non-commercial purposes. You agree not to:
- Reproduce, distribute, or transmit content without permission
- Engage in unauthorized access or hacking
- Transmit viruses, malware, or harmful code
- Interfere with Website functionality or security
- Use automated scraping or data mining tools
- Impersonate any person or entity
- Violate any applicable laws or regulations
4. Products and Pricing
Availability: Product availability is not guaranteed. We reserve the right to update pricing, product descriptions, and availability without notice.
Pricing: All prices are quoted in South African Rand (ZAR) and exclude VAT unless otherwise stated. Prices are valid for the period specified in the quotation.
Accuracy: While we strive for accuracy, we do not warrant that product descriptions, pricing, or other Website content is error-free. We reserve the right to correct any errors.
5. Quotations and Orders
Quotation Validity: Quotations are valid for 30 days unless otherwise stated. Quotations are subject to availability and may be withdrawn at any time.
Order Acceptance: Orders are confirmed upon written acceptance by the Company. The Company reserves the right to refuse or cancel any order at its discretion.
Minimum Order: We reserve the right to impose minimum order quantities.
6. Payment Terms
Payment Methods: Payment must be made via EFT (Electronic Funds Transfer) or as agreed in writing. Payment details will be provided with your invoice.
Payment Due Date: Unless otherwise agreed, payment is due within 30 days of invoice date (Net 30).
Late Payment: Late payments may incur interest at the rate of 2% per month (24% per annum) or the maximum rate permitted by law, whichever is lower, in accordance with the National Credit Act, 2005.
Currency: All transactions are in ZAR unless otherwise agreed in writing.
7. Delivery and Risk
Delivery Location: Unless otherwise agreed, delivery is to the address specified in the order.
Delivery Timeline: Delivery dates are estimates only. The Company will not be liable for delays caused by circumstances beyond its reasonable control (force majeure).
Transfer of Risk: Risk of loss or damage to products transfers to you upon delivery or upon your receipt of goods at your specified location.
Freight Charges: Freight charges are not included unless specifically quoted and must be paid as per the invoice.
8. Returns and Refunds
Damage Claims: Any claims for damaged goods must be reported in writing within 48 hours of delivery. The Company will investigate and may offer a replacement or credit at its discretion.
Returns: Unopened, undamaged products may be returned within 14 days of delivery for a full refund, less any restocking fee not exceeding 15%. Returned products must be in original condition.
Non-Returnable Items: Custom-ordered or specially manufactured products are non-returnable.
Refund Processing: Approved refunds will be processed within 14 working days.
9. Warranties
Product Warranty: Products come with manufacturer warranties as specified in product documentation. Warranty covers manufacturing defects only, not damage from misuse, improper installation, or normal wear.
Disclaimer: EXCEPT AS EXPRESSLY PROVIDED, THE COMPANY MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Warranty Exclusions: Warranties do not cover:
- Improper installation or use
- Environmental damage (moisture, temperature extremes)
- Normal wear and tear
- Damage from cleaning products or chemicals
- Color variation due to batch differences
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR:
- Indirect, incidental, or consequential damages
- Lost profits or lost business opportunities
- Data loss or corruption
- Damage exceeding the purchase price of the product
- Claims arising from your misuse or improper installation
This limitation applies to all claims, whether in contract, tort, or otherwise.
11. Intellectual Property
All content on our Website, including text, images, graphics, logos, and trademarks, are owned by or licensed to the Company and protected by South African copyright law. You may not reproduce, distribute, or modify this content without written permission.
12. Indemnification
You agree to indemnify and hold harmless the Company from any claims, damages, or costs arising from:
- Your violation of these Terms
- Your misuse of our Services or Products
- Your infringement of intellectual property rights
- Claims arising from your improper installation or use
13. Termination
We may terminate your access to our Website and Services immediately, without notice, if you violate these Terms or engage in prohibited conduct. Upon termination, your rights to use our Services cease immediately.
14. Dispute Resolution
Governing Law: These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law provisions.
Jurisdiction: The parties consent to the jurisdiction of the courts of South Africa.
Dispute Resolution: Before pursuing legal action, the parties agree to attempt informal resolution through good faith negotiation. If disputes cannot be resolved, they may be referred to mediation or arbitration as mutually agreed.
15. Consumer Protection Act Compliance
The Company complies with the Consumer Protection Act, 2008 (CPA). Consumers have certain rights under the CPA, including the right to:
- Goods of merchantable quality and fit for purpose
- Protection against fraudulent, misleading, or harmful conduct
- Fair contract terms
- Effective remedies for breach
16. Black Economic Empowerment (BEE)
The Company is committed to Black Economic Empowerment in accordance with South African BEE legislation. Our BEE status and scorecard are available upon request.
17. Amendments to Terms
We may modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our Services constitutes acceptance of the updated Terms. We recommend reviewing these Terms periodically.

19. Severability
